Terms and conditions

PREAMBLE

These general conditions of sale govern the sale of all products offered on the website JINJI.fr. They apply exclusively between the company JINJI, 22 rue des Canettes 75006, Siret: 445 242 662 and any consumer who is a natural person visiting or making a purchase via the site. The customer declares to have read the following provisions before ordering the products. By choosing to acquire products on the JINJI website, the customer expressly accepts the terms set out below.

ARTICLE 1 - OBLIGATIONS OF THE CUSTOMER

The Customer must be aged at least 18 and have legal capacity or the requisite parental authorisation, in order to place an order on the Site. The Customer engages to communicate to JINJI, actual and necessary information for the execution of services and specific situation as requested on line, in particular his/her : name, first name, postal address, n° of telephone, valid e-mail address. The Customer shall be liable for the consequences resulting from false or incorrect information transmitted, or whose recovery is illegal. Once the order has been sent, the Customer will receive an email confirmation which informs the delivery of Products. The Customer can change its data in the section "My account."

ARTICLE 2 - ORDER

The order will be validated only after reception of payment. JINJI reserves the right to cancel or refuse any order of a customer, with whom there would be a litigation relating to the payment of a former order.

ARTICLE 3 - VALIDATION

You declare to have read and accepted the General Sales Conditions before ordering.  The validation of your order is worth acceptance of these General Sales Conditions. Unless proven otherwise, the data recorded by JINJI constitute proof of all transactions between JINJI and its customers.

ARTICLE 4 - PRICES

The prices of our products are given in Euros including all taxes. Shipping cost will be calculated and applied in addition to the price for the products. For all products shipped outside the European Union and French Overseas Territories, the prices will be calculated, tax not included, automatically on the invoice. The customs duties or other local taxes of importation or taxes of the State are susceptible to be demanded. These duties and amounts are not the responsibility of JINJI. They will be at your charge and result in your entire responsibility as much in terms of declarations as in the payments to the authorities and the competent organizations of your country. We advise you to inform yourself about this according to your local authorities. JINJI reserves the right to constantly modify the set in term of products and price according in particular to the constraints related to the suppliers. The products will be billed on the basis of the price list in vigor at the moment of the registration of orders, under the reserve of availability.

ARTICLE 5- AVAILABILITY

Our product offers and prices remain valid as long as they are present on the site, within the limits of available stock. For products not stored in our warehouses, our offers are valid subject to availability from our suppliers. We will advise you of their availability at the time your order is placed. As this information comes directly from our suppliers, there may be errors or modifications in exceptional cases. In the event of unavailability of a product after placing the order, we will inform you by e-mail or by mail as soon as possible. In this case, the Customer will be able then to cancel or modify his/her order and will be reimbursed, amounts already paid. Final or temporary unavailability, would know in no manner of engaging the responsibility for JINJI, could not open any right to compensation or damages in favour of the Customer.

ARTICLE 6 - DELIVERY

JINJI delivers its products in France and around the world. Products are dispatched with the invoice to the delivery address provided by the Customer at the time of the order. The delivery times shown on our website are average time for processing and delivering. In order for these delivery times to be met, the Customer must ensure that he/she has provided accurate and complete information with regard to the delivery address (for example, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).

When the goods are to be delivered at different moments according to their availability, the delivery delay is grounded on the longest delay. Nevertheless, JINJI reserves the right to split the order in several shipments. The processing and shipping fees will only be invoiced once. JINJI would not be held responsible for the consequences due to a delay in delivery. In case of delay, an email will be sent.

Any order not dispatched within 30 days will be cancelled, unless stipulated otherwise and specified in the sales offer. The times indicated are average times and correspond to the time for processing and delivery for products destined for metropolitan France. In case of split delivery of an order, only products dispatched will be debited from your account. In case of damaged delivery (already opened, missing product...), the Customer is due to notify the transport service and JINJI, by any means, any reserve within 3 days of receiving the product. JINJI would not be held responsible for the consequences by delay in delivery due to external factors.

ARTICLE 7 - PAYMENT

Full payment must be made upon ordering. The sums paid can never be considered to be deposits or part payments. The Customer shall pay for his/her order by bank card (Visa, Eurocard/Mastercard, American Express), via PayPal, in accordance with the provisions of the article. For each transaction, the Customer must provide the number appearing on the front of the card, the expiry date of the card and the security code appearing on the back of the card (last three digits). Provision by the Customer of his/her bank card number constitutes authorisation for JINJI to debit his/her account up to the amount of his/her order. No cash with order will be accepted, whatever the motive is.

JINJI retains ownership of the item until the Customer has paid in full for the item. Purchases are made securely. JINJI uses 100% secure payment solutions. For payments by credit card (carte blue, carte blue Visa and e-carte blue), all information provided by Customers to JINJI is rigorously protected ensuring the confidentiality and security of each transaction.

ARTICLE 8 – PRODUCT(S) EXCHANGES AND RETURNS

RIGHT OF WITHDRAWAL

The Customer has 15 days following receipt of his/her order to inform JINJI to return or exchange the Product(s) For that purpose, the Customer will use the return form that came with the order including all the information to proceed with the refund or exchange the Product (s). The Customer has to pay for the transport charges, except for the products with a manufacturing defect or do not correspond to the initial order of the Customer. Any return or exchange is at the Customer's risk. The Product must be returned in its original packaging, in its original condition, new, unworn, unwashed, to the following address:

Any articles return which are incomplete, damaged, or soiled by the Customer would not be accepted. The returned Product will be refunded or exchanged within a maximum of fifteen (15) days from the receipt by JINJI. Reimbursement will be made by crediting the Customer's bank account or by check sent to the customer who placed the order and billing address. No return for cash on delivery will be accepted for any reason. If the Customer fails to comply with these conditions, in particular the return or exchange conditions, JINJI will not be able to refund the Products in question.

ARTICLE 9 - SECURITY

The electronic payment system is subject to a security system (encoding SSL) for sensitive data linked to methods of payment.

ARTICLE 11 - LIABILITY

JINJI only has an obligation of means for all the steps including website access, the ordering process, delivery or subsequent services. JINJI cannot be held liable for any harm inherent in using the Internet, such as a breach in service, outside intrusion or the presence of a computer virus, or for any event deemed to fall under force majeure, as recognised by law. The proposed products are in accordance with the French legislation current and with the applicable standards in France. JINJI is not responsible in case of non-respect of the legislation of the country where products are delivered. (for example in the event of prohibition of a product...). It is your responsibility to check with local authorities the possibility of importing or use of products or services that you plan to order.

Photographs and graphics reproduced and illustrating the products presented are given by way of an indication. JINJI could not be held for the person in charge for the inexecution of the contract concluded in case, cause beyond control, disturbance or all-out strike or partial in particular of the mail service and means of transport and/or communications, flood, fire, etc. JINJI undertakes to use the Customer's confidential information exclusively for the purposes of its services and internal use. For the success of the order, personal data collected will be processed by computer, and the customer acknowledges having knowledge of this matter.  Because of this fact, the information concerning the customer can be transmitted to the technical service providers of JINJI.

Furthermore, JINJI will be able to apply technical means to obtain non-personal information about Internet users and to improve the functionalities of the website, for example by tracking the number of visitors on selected pages. In compliance with the Act of 6 January 1978, as amended by Act of 6 August 2004, the Customer is entitled to access his/her personal data, and to correct it concerning and contained in the files of JINJI. ARTICLE 12 - INTELLECTUAL PROPERTY

Under no circumstances the Customer is authorized to download or modify the Site, in whole or in part, and in particular its content (products listed, descriptions, images, videos, etc.). No part of this Site may be reproduced, copied, sold or used for commercial purposes without the express written permission of JINJI. Generally speaking, all copyrights, trademarks and other distinctive signs and property or intellectual property rights appearing on the Site shall remain the full and entire property of JINJI. The Customer is therefore legally obliged to respect all intellectual property rights and may in no way use the trademarks appearing on the Site and where applicable on the Products, or register a trademark that is prejudicial to the rights holder, unless otherwise contractually stipulated. The same shall apply to any other intellectual property right.

ARTICLE 13 – ACTUALIZATION

The present general conditions can be modified constantly and without notice by JINJI, but the terms applicable are those enforced on the date your order is placed. These present General Conditions of Sale can be accessed at any time at the following address: www.jinji.fr/content/3-conditions-generales-de-ventes in electronic formats that allow them to be printed and/or downloaded, so that the Customer can reproduce them or save them.

ARTICLE 14 - APPLICABLE LAW, DISPUTES

These General Conditions of Use are subject to French law, in regard to fundamental rules or to rules pertaining to form. Any dispute will have to be the object of an attempt of amicable settlement. If it is not amicably settled, jurisdiction be granted to a French court, despite multiple defendants or collateral.

When you use our services, notably those available on the website, mobile site, Jinji, who is responsible for handling data, may collect and process your personal data. Jinji is devoted to complying with privacy rules of users and visitors to our website and mobile site. All the data processing implemented in the frame of the accessible services comply with local regulations that apply for the protection of personal data and in particular, the provisions of the modified “Data Freedom Act” of 6 January 1978 and the General Data Protection Regulation (Regulation EU 2016/679) or “GDPR”.

HOW LONG IS YOUR DATA STORED ?

JINJI undertakes to store your personal data for a period that does not exceed that required for the purposes for which they are processed. Furthermore, Jinji stores your personal data in accordance with the retention period imposed by current regulations. This storage periods are defined according to the processing purposes implemented by JINJI and, in particular, take account of the legal provisions which apply imposing a precise storage period for certain categories of data, any limitation periods that apply, as well as the CNIL’s recommendations concerning certain categories of data processing. (for example, Deliberation n° 2016-264 of 21 July 2016 introduces modifications to this simplified declaration concerning automated data processing related to clients and prospects (NS-048), article L.232-7 about national security with regard to transmitting passenger details to the French authorities, storing cookies for 13 months according to CNIL recommendations...).

These rights may be exercised directly on the website for managing your personal account.

You also have a right of appeal to the Commission Nationale de l'Informatique et des Libertés (French Data Protection Agency) in the event of a breach of the regulation that applies concerning the Data Protection and the GDPR in particular.
You also have the right to refuse for your data to be collected for marketing purposes. When required by law, personal data will only be used for online marketing once your express consent has been obtained.

We offer you a secure online payment system. Jinji does its utmost to combat identity theft on the Internet. That is why, for example, we use a detection system for fraudulent payments made by credit card. This system protects you in the case of the loss or theft of your credit card.
